CMS Product Warranty Terms and Conditions

Two (2) Year “Limited Warranty” for all CMS products except Monitors of which carry a four (4) year “Limited Warranty”

CMS, products (“Product”) are warranted to be free from defects in workmanship and material under normal use and are warranted to meet the Company’s published specifications. CMS makes no other warranty, express or implied, including warranties of merchantability or fitness for a purpose, unless expressly set forth in writing. The warranty period will be for a period of twenty- four (24) months and/or forty-eight (48) months starting from the date of delivery of the aircraft to the end customer or operator; whichever period ends first. Repaired and Overhauled Items: twelve (12) months following the delivery of the repaired or overhauled Item to the operator.

If a defect arises and a valid claim is made to CMS, the company will either (1) repair or rework the Product; or (2) exchange the Product with hardware that is new, or which has been manufactured from new or serviceable used parts. CMS is not responsible for damage arising from failure to follow instructions relating to the product’s use. CMS is not responsible for any or all costs associated with removal or reinstallation if a defect arises.

Exclusions and Limitations

CMS shall have no obligation or liability under this warranty:

  1. For special, indirect, or consequential personal or property damage arising from the failure of the Product.
  2. If the Product is operated with any accessory, equipment or attachment not specifically approved by CMS.
  3.     If the Product was not installed, operated, or maintained in accordance with CMS installation maintenance/instructions.
  4.     If the Product was not used or operated under normal industry applications unless CMS specifically approved the installation.
  5.     If the Product was serviced, repaired, altered, or modified in any way by a company other than CMS.
  6.     For damage resulting from interface with third party hardware or software except as agreed in writing between Customer and CMS
  7.     For damage, both cosmetic and/or through misuse, including scratches, dents, over-rotation, bending or breaking of parts.
  8.     If serial number or Product label has been removed, tampered with or defaced.

 

Warranty and Administration

The customer must notify CMS of all warranty claims within thirty (30) days after the discovery thereof. Contact either CMS or a CMS authorized dealer by telephone or email. Please access and review online contact information for the company www.cmsaero.com or call +1.936.523.1700

Units submitted for warranty consideration must be returned to CMS freight prepaid. All transportation charges, both in-bound and out-bound freight, are the responsibility of the customer.

All units sent to CMS must have an RMA number [Return Material Authorization], date of installation, valid shipping ticket detailing: purchase order number, customer and address, telephone number, person to contact, part number and serial number, complaint or squawk and return routing instructions. If the requisite paperwork has failed to be properly and fully completed to the satisfaction of CMS, then any claim may be rejected at the sole discretion of CMS.

CMS reserves the right to repair or replace customers’ units at its discretion. CMS reserves the right to make improvements and or changes to its Products any time a unit is submitted for warranty repair or exchange consideration.

CMS reserves the right under this warranty to refuse or reject any and all warranty claims for any reason whatsoever if, based on CMS estimation, damage to subject Product(s) was not caused by component or factory workmanship defects.

CMS WARRANTY OBLIGATION IS LIMITED TO THE REPAIR AND/OR REWORK OF THE DEFECTIVE PRODUCT. THE FOREGOING LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY. CMS SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OF AN INDIRECT NATURE.
